1. Terms and Conditions for Everest Outdoor
1.1 These terms and conditions (”Terms and Conditions”) apply when you as an individual make a purchase from [www.everestoutdoor.com] (the “Website”). When you make a purchase on the Website, an agreement is entered into between you as an individual and Stadium Sweden AB, with organization number 556236-4397 and address [Norra Promenaden 63, 602 38 Norrköping]. (”Everest Outdoor”, ”us” or ”we”).

2. Agreement and order
2.1 We do not sell to companies - only customers who act as private individuals (consumers). When you make a purchase on the Website, you will accept these Terms and Conditions, which apply to all purchases. We do not have a minimum order amount. The maximum order amount allowed is 5000€.
2.2 When you have completed your purchase, you will receive an order confirmation to the email address provided in connection with the purchase. This is a confirmation of your purchase and proof of a binding agreement.
3. Age limit
3.1 You need to be 18 years of age or over and have the right to enter into an agreement in accordance with applicable law, e.g. not be under guardianship, to make a purchase on the Website.
4.1 When ordering, the prices that are stated on the Website at the time of ordering apply. All prices are represented including applicable VAT.
4.2 When a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, the price or information will not apply to the purchase. If that type of error occurs, we will contact you as soon as possible.
We offer different payment methods for you to choose from. The available payment methods are always stated in the checkout. Additional costs may apply, depending on the method of your choice. You can read more about our payment methods and the costs for these here.
6. Shipping and deliver
6.1 Your order is to you with the delivery method you choose at the checkout. You will find information about your options on the Website and at the checkout. We offer free shipping with some delivery methods providing your purchase exceeds a certain amount. We will inform you about this on the Website. You will find complete information about delivery options and delivery costs here.
6.2 We do not deliver to Aland Islands and Greenland.
7. Estimated delivery time
7.1 The estimated delivery time is stated on the Website and in the order confirmation and may differ depending on the chosen delivery method. The estimated delivery time stated on the Website is calculated from when the order is placed and an order confirmation Is received. We always strive to deliver your order within the estimated number of working days stated on the Website and on your order confirmation.
7.2 If we are unable to deliver the order within the promised delivery time, a new time will be offered. The customer can either accept the new time or cancel the order and receive a full refund.
8. Right of withdrawal and extended return policy
8.1 According to EU consumer protection legislation, you have the right to cancel your purchase within 14 days from the day you, or a person on your behalf, receive the product that you have purchased on the Website.
8.2 When you exercise your legal right of withdrawal of 14 days, you have the right to open the package and examine the product to the extent required in order to assess its character, quality and function. In these cases, you have the right to a full of the product price if you notify us within 14 days from the day you received the product. Please note that you must pay for return shipping. If you handle the product to a greater extent than required to assess its character, quality, and function, we have the right to reduce the refund according to the decrease in value. 8.3 In addition to the right to withdrawal, we offer an extended return policy of another 16 days (a total of 30 days). However, we only offer these extended return policy terms for products that are completely unused. Se section 8.4 for more details. Please note that you must pay for return shipping.
8.4 If you wish to use our extended return policy after the statutory 14-day right of withdrawal has expired, you may do so for up to 30 days after delivery of the product, provided that the product is unused, in its original condition, all labels attached and in its original packaging. Original packaging only refers to products with a cardboard box, e.g. shoes, helmets, and goggles etc.
The right of withdrawal and extended returns do not apply for certain products.
8.5 For certain products, neither the right of withdrawal nor open return apply. If a product is not suitable for return due to health and hygiene reasons, you will not be able to return the product if you have broken the seal on the product. Also, you do not have the possibility to return a product that has been manufactured according to your instructions or that otherwise been given a clear personal touch. If the right of withdrawal or right to return does not apply, it will be stated in connection with the product.
How to return
8.6 You can use your right of withdrawal or extended returns in several different ways. For easy handling and faster refunds, we recommend that you register your return here and follow the instructions on how to send the product back to us. You can always contact us thru the email address stated in section 1.2 of these Terms and Conditions or use our form for exercising the right of withdrawal which you can find here. 8.7 After you have notified us that you want to make a return, you need to send the product back to us within 14 days. We recommend that you return the product in the same package you received it in, since you are responsible for any damage or loss during the return shipping caused due to your negligence, for example when choosing a carrier or when or packaging the product.
Costs of return shipping
8.8 When making a return you pay for the cost of the return shipping. If you choose the return shipping we offer, stated in section 8.6, the cost is €4,9 and it will be deducted from your refund.
9. Refund for your right to withdrawal and our extended return policy
9.1 If you use your right of withdrawal within 14 days, we have the right to deduct an amount equal to the products value reduction if you have used the product more than necessary to determine its character, quality and function. Such a deduction is made according to the product’s value upon return compared to the original value at the time of purchase. If you want to return a purchase after the 14-days legal right of withdrawal has passed, you are entitled to a refund for up to 30 days from the time you received the product with our extended return policy, provided that the product is unused, in its original condition, all labels attached and in its original packaging.
9.2 When you use your right of withdrawal within 14 days, we will process your refund within 14 days from the day you notified us of your wish to cancel your purchase or announced that you wish to use your right to return. However, we will not issue the refund until we have received the returned product or before you have shown that you have sent it to us. Refunds will be issued to your original payment method, unless otherwise agreed. Note that depending on the payment method you chose at the time of your purchase, it may take a few extra days for us to process the refund.
9.3 When you use our extended return policy after the first 14 days, we will await the returned product and inspect it before we make your refund. We only accept your return and issue your refund if the product is unused, in its original condition, all labels attached and in its original packaging.
10.1 If there is something wrong with your product, you have the right to make a claim of the faulty product in accordance with mandatory consumer protection legislation that applies in the country where you have your usual place of residence. You have a right to make a claim within three years after the day you received the product. You always need to make your claim within reasonable time after you have detected any defect. Your right to make a claim expires no later than two months after the three-year period has passed.
10.2 To make your claim, we recommend that you register it here. If you choose not to use our registration you can contact us by the email address stated in section 1.2 of these Terms and Conditions. If you want to make a claim, please contact us as soon as possible after you have discovered the defect.
10.3 When the product in question has been received and it has been established that the claim is justified, we will reimburse you in accordance with applicable law.
11. Defect product or delayed delivery
11.1 If there is any defect in your or if the delivery is delayed, we are responsible for the damage you suffered as a result of the defect or delay in accordance with applicable mandatory consumer protection legislation. However, we are only liable for damages to the extent that you have taken reasonable steps to limit your damage. We are therefore not responsible for damages that you could have avoided by taking reasonable steps to mitigate your losses.
12. Uncollected packages
12.1 You are responsible for receiving or collecting your package in accordance with the instructions you receive in connection with . Packages that are not collected within the time specified on the advice note will be sent back to our warehouse. We have the right to charge a fee of [enter amount SEK] which corresponds to our costs for shipping in cases where you do not collect your package. If you notify us that you want to withdraw your purchase before the package is automatically returned, we will not charge the fee for uncollected packages.
Everestoutdoor.com uses SSL (Secure Socket Layer), which is an encryption protocol for secure data transfer. SSL was developed by Netscape Communications. SSL uses a digital certificate to verify the sender and recipient of the data transfer. On the webpage everestoutdoor.com, Verisign is used as the issuer of the certificate. The certificate is of the Secure Site Pro with EV type, which provides the highest possible encryption for Microsoft and other browsers. The Secure Site Pro with EV certificate uses 256-bit encryption, allowing you to use the latest features in modern browsers. An example of this is the ”green” address field, which indicates that the communication is secure. We use Adyen for payment processing.

15. About these Terms and Conditions
15.1 We have the right to change these Terms and Conditions, but the Terms and Conditions that you agreed to at the time of your purchase will always apply to that purchase. All changes will be stated in the latest published version of the Terms and Conditions on the Website. Changes will be effective from the time you have accepted the Terms and Conditions, i.e. in connection with you making a new purchase on the Website.
15.2 These Terms and Conditions shall be interpreted and applied in accordance with Swedish law. If any provisions of these Terms and Conditions would be considered invalid or unenforceable by any competent court, authority or alternative dispute resolution body, the other parts of that provision and all other provisions of these Terms and Conditions will remain valid and fully enforceable in accordance with applicable law.
15.3 We are a Swedish company with our head office in Sweden and are therefore covered by both Swedish and European law. However, you always have the right to exercise the rights available for consumers in the country where you have your usual place of residence. This means that we will always comply with mandatory consumer protection legislation that are in force in your country. We have no intention of excluding or restricting such rights through these Terms and Conditions.

17.1 In the event of a dispute, we follow decisions from alternative dispute resolution bodies. The alternative dispute resolution body in your country is Stichting Geschillencommissies voor Consumentenzaken (SGC). You also have the opportunity to complain via EU’s web-based dispute resolution platform, which you can access here.
17.2 Notwithstanding the above, any disputes may also be settled in any competent court where the customer is domiciled.
18. Force Majeure
18.1 We are not liable for damages caused by unforeseen circumstances beyond our control, for example wars, natural disasters or pandemics - as declared by the WHO, which we could not reasonably have foreseen (Force Majeure). However, you always have the right to cancel the purchase in accordance with mandatory consumer protection legislation.
